California’s Updated Probate Code – What Has Changed?

Small Estate Probate Update: California’s updated Probate Code § 13150 allows eligible heirs to bypass full probate for a primary residence valued at up to $750,000. But there’s a catch.
The court doesn’t simply take your word that the property was the decedent’s primary residence, you must be prepared to prove it. In many cases, that means providing documentation, such as a utility bill or other records, showing the home was actually the decedent’s primary residence.
This often-overlooked requirement can determine whether you qualify for the simplified small estate process, so it’s important to have the required documentation before filing.
